Atrium Medical Corporation built a multimillion-dollar business selling C-Qur hernia mesh to hospitals nationwide, even as reports of chronic pain, infection, and organ perforation tied to the product piled up. Nearly a decade after federal regulators first intervened, the C-Qur litigation is still working through the courts, and patients who were implanted with the mesh are still coming forward.

At the Hollis Law Firm, we have represented clients hurt by defective hernia mesh products, including C-Qur, and we track the litigation closely so our clients understand where their case stands.

Atrium C-Qur Hernia Mesh Widely Used After a Hospital Purchasing Agreement

Premier Inc. (Charlotte, NC) is a supply chain company that gives hospitals discounted medical equipment when they agree to buy pre-negotiated supplies through specific vendors. Hundreds of hospitals across the country participate in Premier’s ASCEND program, which represents billions of dollars in supply chain purchasing volume and tens of thousands of hospital beds. Atrium Medical Corporation was one of the vendors negotiated into that program for surgical mesh products. In August 2010, Atrium was awarded a three-year dual-source agreement with ASCEND hospitals, and the previously obscure C-Qur hernia mesh quickly became a widely used product.

Atrium C-Qur Hernia Mesh Received Awards for Low Cost, Not Safety

In June 2013, Atrium received an industry “Peak Performance Award” for helping ASCEND hospitals lower costs, largely by selling C-Qur hernia mesh at a discount to hundreds of hospitals. In an annual report, Dr. Alan L. Schuricht, a hernia repair specialist from the University of Pennsylvania Hospital, praised Atrium for its “cutting edge technology” and “patient-first focus.” Federal payment-disclosure records show. Dr. Schuricht was paid $12,000 by Atrium in 2013 and another $9,000 in 2014, the same period he was publicly endorsing the company’s products. Atrium collected industry accolades while evidence mounted that C-Qur hernia mesh caused chronic groin pain, infection, nerve damage, and organ perforation in patients.

FDA Injunction Exposed Manufacturing and Reporting Failures

On February 4, 2015, the Department of Justice announced a permanent injunction against Atrium at the request of the FDA. The injunction found that Atrium failed to meet sterilization requirements for its C-Qur products and had neglected complaints from consumers and medical staff. The order shut down the Hudson, New Hampshire facility where the mesh was manufactured, but by then many hospitals had already purchased large quantities of the discounted mesh, and some of that inventory continued to be implanted in patients for years afterward.

Where the C-Qur Litigation Stands Today

The federal C-Qur hernia mesh cases were consolidated into multidistrict litigation, MDL No. 2753, before U.S. District Judge Landya McCafferty in the District of New Hampshire. In the years since consolidation, the court approved a qualified settlement fund to resolve a large group of pending C-Qur claims, and the settlement agreement filed with the court laid out how eligible claims would be evaluated and paid. As of mid-2026, the Atrium MDL docket still shows active cases moving through case management, meaning the litigation has not fully closed and new claims continue to be evaluated. Settlement funds and litigation outcomes vary by individual case, and no result is guaranteed.

Many patients who received a C-Qur hernia mesh lawsuit-eligible implant never knew which brand of mesh was used until they, or their attorney, requested surgical records and device tags directly from the hospital. If you had hernia repair surgery and later developed unexplained pain, swelling, or signs of infection near the surgical site, it is worth confirming which mesh product was used, even if you do not recall the brand name.

Recognizing C-Qur Hernia Mesh Complications

Reported complications associated with C-Qur mesh include the following:

  • Chronic pain or groin pain that persists well beyond the normal healing window after hernia repair.
  • Infection at or near the mesh site, sometimes requiring additional surgery to remove the device.
  • Bowel or organ perforation, linked to the mesh’s fish-oil-based coating breaking down inside the body.
  • Mesh migration or adhesion, where the device shifts or fuses to nearby tissue and organs.

Symptoms can appear months or years after the original surgery, which is one reason many affected patients did not connect their symptoms back to the mesh right away.

Legal Options for Patients Harmed by C-Qur Mesh

Patients pursuing a hernia mesh lawsuit generally allege that Atrium knew or should have known about the risks associated with C-Qur mesh and failed to adequately warn hospitals, surgeons, or patients. Building that kind of claim typically requires medical records confirming which device was implanted, documentation of complications and any follow-up procedures, and an understanding of how the specific device relates to the broader Atrium hernia mesh litigation. An attorney experienced in mass tort litigation can help identify whether a claim may fit within the existing settlement structure or needs to be pursued individually.

Frequently Asked Questions About the C-Qur Hernia Mesh Litigation

How do I know if I had C-Qur hernia mesh implanted?

Hospitals are required to keep a record of the specific device used during surgery, including a device tag or lot number. You or your attorney can request your complete surgical and implant records from the hospital where your hernia repair took place to confirm the mesh brand and model.

Is the Atrium C-Qur litigation still active in 2026?

Yes. While a qualified settlement fund has resolved a portion of the C-Qur claims filed in the federal multidistrict litigation, cases continue to move through the court in New Hampshire, and new claims are still being evaluated. Case outcomes depend on individual facts, and no result can be guaranteed.

What symptoms suggest a problem with hernia mesh?

Persistent or worsening pain near the surgical site, signs of infection such as redness or drainage, swelling, fever, or new digestive symptoms can all indicate a mesh-related complication. Any of these symptoms after hernia repair surgery should be evaluated by a physician.

How long do I have to file a hernia mesh claim?

Deadlines vary by state and depend on when the complication was discovered, not necessarily when the surgery occurred. Because these deadlines can be easy to miss, it is best to speak with an attorney as soon as possible after noticing symptoms or receiving a related diagnosis.

Does it cost anything to have a hernia mesh case reviewed?

The Hollis Law Firm reviews hernia mesh cases on a contingency fee basis, meaning there is no upfront cost and no fee owed unless we recover compensation for you. All case reviews are confidential.
